Ms T Afzal v The Chief Constable of West Yorkshire Police: 1800964/2019
JUDGMENT
The complaints of unfair dismissal and breach of contract are struck out.REASONS
[1]The claimant was a police officer excluded by statute from the right to claim unfair dismissal and without the position of employee, viz a viz the Chief Constable.[2]By a Tribunal Order dated 25 June 2019 the Tribunal gave the claimant an opportunity to show cause why the above complaints should not be struck out. She was encouraged to seek legal advice on these matters. She provided her representations on 4 July 2019, which do not address these fundamental difficulties and essentially ask the Tribunal to disapply the law in her case.[3]That being a path not open to the Tribunal, these claims are struck out. The representations may be relevant to her complaints of discrimination (which also include a complaint about dispensing with her services), and there is a hearing arranged to address whether they have been brought within the relevant time limit to take place on 9 October 2019.
