JUDGMENT

[1]In respect of the issue of whether the claimant’s unfair dismissal complaint was presented within the time limit provided for in section 111(2) of the Employment Rights Act 1996, the judgment of the Tribunal is that:1.1 The unfair dismissal complaint was not presented within the time limit provided for in section 111(2)(a); and1.2 For the purposes of section 111(2)(b), it was reasonably practicable for the claimant’s unfair dismissal complaint to be presented within the time limit provided for in section 111(2)(a). Accordingly, the Tribunal does not have jurisdiction to hear the claimant’s unfair dismissal claim because it was presented outside the time limit.[2]The Tribunal is satisfied that the claimant’s unauthorised deduction from wages claim has no reasonable prospect of success. Accordingly, the claimant’s unauthorised deduction from wages claim is struck out.
