JUDGMENT
[1]There was a relevant transfer of an undertaking, within the meaning of regulation 3(1)(a) of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE), from Corona Caravans Limited to the respondent, in December 2016 and January 2017.[2]The claimants were not assigned to the organised grouping of resources or employees that was subject to the relevant transfer, for the purpose of regulation 4(1) of TUPE, with the consequence that their employment did not transfer to the respondent.[3]As all claims brought against the respondent were conditional upon the contracts of employment of the claimants having transferred to the respondent, in the light of the above finding, all claims are dismissed.
