Mr A Bonner v BOC Ltd: 1800740/2023
JUDGMENT
The claim is struck out.REASONS
[1]On 10 October 2023 the Tribunal warned the claimant that his claim might be struck out because he had not complied with the Tribunal’s orders to send his documents and witness statement to the Respondent. He had been ordered to do so by Employment Judge James on 27 June 2023. He had made repeated requests for an extension of time. He referred to his mental health but did not provide any medical evidence. On 22 September 2023 Employment Judge Cox refused his most recent application for an extension of time. She noted that he had not provided medical evidence. She told him that he must comply with the order for a witness statement without further delay. He did not do so. That led to Employment Judge Cox’s strike out warning on 10 October 2023. The claimant has not made representations objecting to the strike out of his claim and has not requested a hearing at which to do so. It is consistent with the overriding objective to strike out his claim in the circumstances.
