The claim is struck out.REASONS
[1]By a letter dated 15/04/2019 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claim (for sums arising in 2017) had not been presented until 2019.[2]By an email dated 15 April 2019 the claimant set out a chronology and apology indicating why the claim had been presented outside the Tribunal’s limitation period, including within it that she had secured a County Court enforcement.[3]There is nothing in the information provided which suggests it was not reasonably practicable to bring the complaints to the Tribunal in time as many litigants do. Further if the matters are the subject of a County Court Judgment, as appears the case, the Tribunal is prevented from considering them again. (Estoppel).[4]For both these reasons the claim has no reasonable prospect of success and must be struck out. The claimant’s view that she was badly advised does not address these two fundamental problems with her claim. 7 May 2019
