There is no reasonable prospect of the original decision being varied or revoked, because it is not in the interests of justice to do so. The application is an attempt to reargue the case which was before the Tribunal. No new evidence which was not reasonably available at the time of the hearing is sought to be relied upon. The investigating officer was not the decision marker in this case and the Claimant did not challenge the dismissing officer, Mr Barnes, in respect of the genuiness of his own conclusions regarding the allegation of misconduct. It was never suggested to him that the investigating officer had expressed a view in support of the Claimant. The length of notice of the disciplinary hearing was clear to the Tribunal but the evidence was not of him objecting to the continuance of the hearing but in fact of him being fully able to participate and present his case.
