JUDGMENT

[1]The claimants’ complaints under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 of a failure by the respondent to comply with the requirements of section 188 of the 1992 Act is well founded. The Tribunal orders the respondent by way of protective award under section 189(3) of the 1992 Act to pay to the claimants listed in schedule C remuneration for the period of 90 days beginning on 21 December 2018. The Recoupment Regulations apply.

[2]All other claims raised by the claimants are stayed. Those claims shall stand dismissed on 6 August 2020 unless on or before 5 August 2020 there is an application to lift the stay and relist those cases for hearing before the Tribunal.
