JUDGMENT

[1]The respondent did not unfairly dismiss the claimant. Accordingly, the complaint of unfair dismissal fails.[2]The claimant’s claim for unauthorised deduction from wages in respect of the respondent’s sickness absence fund is not well founded. Accordingly, the complaint of unauthorised deduction from wages in respect of the respondent’s sickness absence fund fails.[3]The claimant’s claim for unauthorised deduction from wages in respect of underpayments of holiday pay is well founded.[4]The claimant was underpaid in respect of 11 days’ holiday. The tribunal will decide the remedy for unauthorised deduction from wages at a further hearing.
