The claim is struck out on the ground that it has not been actively pursued.REASONS
[1]The Claimant failed to attend a Preliminary Hearing for case management on 28 May 2019 and provided no explanation for his non-attendance.[2]The Tribunal’s administrative staff contacted the Claimant and left a message on his mobile ‘phone voicemail to confirm that the Hearing was about to start. He did not respond to that message.[3]The Tribunal then notified the Claimant that it was proposing to strike out his claim on the ground that it had not been actively pursued. It ordered him to provide any comments he wanted to make in response to that proposal, or to request a Hearing at which he could make them, by 11 June 2019. He failed to respond to that Order or to contact the Tribunal.[4]The Tribunal is satisfied that the Claimant has not actively pursued his claim and it is appropriate to strike out the claim on that ground, using its powers under Rule 37 of its Rules of Procedure.
