JUDGMENT

[1]The Claimant’s claims against R2, R3 and R4 are dismissed on withdrawal.[2]This action shall be cited as against R1 only hereafter.[3]The Claimant’s claims under Regulations 13 and 14 of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”) are dismissed on withdrawal.[4]The Claimant’s claim of automatically unfair dismissal under Section 104(4)(e) of the Employment Rights Act 1996 (as amended) (“ERA”) is dismissed on withdrawal. 1 of 2 Case Number: 1800050/2024

REASONS

[5]At the Preliminary Hearing listed for today's date the Claimant was asked through his representative to clarify his claims in this action and through her he confirmed that upon advice he accepted that he could not pursue the above mentioned claims under the above mentioned heads of cause of action and nor could he pursue claims against R2, R3 and R4. This leaves only R1 facing the claims which remain. 4. Accordingly the Claimant accepted that he need only proceed with his remaining complaints listed in the case management Orders promulgated today. 5. The Respondent readily consented to withdrawal on such terms without further recourse.
