JUDGMENT

The claim is dismissed on withdrawal by the Respondent and on the Respondent’s undertaking not to apply for costs against the Claimant.

REASONS

[1]This case was listed for a full hearing. On the morning of the hearing the Tribunal heard evidence from two of the Respondent’s witnesses Martin Doyle and David Phillips.[2]At the luncheon interval it became apparent that the Claimant had admitted the substance of the reason for his summary dismissal and the Tribunal addressed the parties before the luncheon interval so that consideration could be given during the luncheon interval to the future of the claim. Case No: 1800008/2018[3]The parties came back after the luncheon interval and the Claimant indicated that he wished to withdraw claim, which the Tribunal dismissed on such withdrawal and on the undertaking of the Respondent not to pursue the Claimant for costs.
