[1]There was a relevant transfer for the purposes of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”) from the First Respondent to the Second Respondent on 1 May 2024 (“Relevant Transfer”).[2]The Relevant Transfer did not operate so as to terminate the contract of employment of any of the Claimants but that:a. any such contract had the effect after the Relevant Transfer as if originally made between each Claimant and the First Respondent; and 1604106/2024 1604107/2024 1604108/2024 1604109/2024b. all of the Second Respondent’s rights, powers, duties and liabilities under or in connection with any such contract were transferred to the First Respondent by virtue of Regulation 4 TUPE.[3]The claims for notice pay, accrued untaken holiday pay and redundancy payments are dismissed.
