JUDGMENT

[1]The complaint of unfair dismissal is made out and succeeds.[2]The compliant of unauthorised deduction from wages is made out and succeeds.[3]The Respondent must pay the Claimant the sum of £53,285.24, calculated as follows: £ 3.1. Basic award 18,325.50 3.2. Compensatory award 3.2.1. Loss of earnings 1/8/23 – 28/5/24 25,604.35 3.2.2. Loss of earnings 29/5/24 – 31/7/24 5,359.05 3.3. ACAS uplift (10% of loss of total earnings award) 3,096.34 3.4. Loss of statutory rights 600.00 3.5. Unauthorised deduction from wages 300.00 Total 53,285.24 - 1 -[4]The Employment Protection (Recoupment of Jobseeker’s Allowance & Income Support) Regulations 1996 apply and attention is drawn to both the following paragraph and the Annex to this judgment.[5]The total monetary award made to the Claimant is £53,285.24. The prescribed element is £25,604.35. The dates of the period to which the prescribed element is attributable are 1 August 2023 to 28 May 2024. The monetary award exceeds the prescribed element by £27,680.89.
