JUDGMENT
[1]The complaints of:a. direct disability discrimination (contrary to s13 Equality Act 2010); andb. discrimination arising from disability (contrary to s15 Equality Act 2010) are struck out as they have no reasonable prospect of success.[2]The claimant’s remaining claims, for unfair dismissal and breach of s10 Employment Relations Act 1999, remain listed for hearing on 16th & 17th September 2021.REASONS
[1]By emails dated 10 & 13 September 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:• the manner in which the proceedings have been conducted by or on behalf of the claimant has been unreasonable due to her refusal to provide a witness statement;• the claimant had not complied with the Order of the Tribunal dated 24 June 2021.• it has not been actively pursued due to the failure to provide a witness statement.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. Written reasons have been provided by the Tribunal why the claim has been struck out.[3]The hearing fixed for 16 & 17 September 2021 will not take place.
