JUDGMENT

The claim of trade union detriment (s146 Trade Union and Labour Relations (Consolidation) Act 1992) is struck out. This does not affect the remaining claim of disability discrimination.

REASONS

[1]By a letter of 7 February 2025, the Tribunal gave the Claimant an opportunity to make representations or to request a hearing as to why the complaint of trade union detriment should not be struck out because it did not have a reasonable prospect of success.[2]The Claimant did not respond by the deadline of 21 February 2025 but his representative confirmed receipt of the strike out warning.
