JUDGMENT

The complaint of unfair dismissal is struck out.

REASONS

[1]By a letter dated 28 March 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because  The claimant was employed for less than 2 years.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of unfair dismissal is therefore struck out.[3]The claimant’s remaining claims of breach of contract and holiday pay remain listed for hearing on 30 June 2022. _____________________________ Employment Judge Sharp Dated: 3 May 2022[1]The Claimant’s claim for unpaid wages is not well-founded and is dismissed;[2]The Claimant’s claim for notice pay is well-founded and the Respondent is ordered to pay one week’s gross pay of £174.40;[3]The Claimant’s claim for unpaid annual leave is well-founded and the Respondent is ordered to pay £517.20;[4]The Claimant having established that the Respondent failed to provide a written statement of employment particulars is entitled to be paid two weeks’ gross pay of £348.80;[5]The Claimant claim for “tips” is withdrawn and is dismissed.
