JUDGMENT
[1]The claimant was unfairly dismissed by the Respondent. His claim of unfair dismissal succeeds.[2]The Respondent shall pay to the Claimant by way of compensation the sum of £1870 (one thousand eight hundred and seventy pounds).[3]The above amount is made up of a basic award in the sum of £1320, (the claimant was employed by the Respondent for a period of two years both of which were when the claimant was over the age of 41; he is entitled to 1.5 weeks’ pay for each year worked capped at his gross weekly wage of £440), and a compensatory award of £550 representing his loss of statutory rights and loss of earnings as a result of his dismissal.[4]The claimant’s claim that the respondent suffered an unlawful deduction from wages is not well founded and is dismissed.[5]The claimant’s claim of breach of contract (notice pay) is not well founded and is dismissed Case No. 1601981/18[6]The claimant’s claim for payment in lieu of annual leave accrued but not taken under the Working Time Regulations is dismissed upon withdrawal by the claimant.
