JUDGMENT
The judgment of the Tribunal is that the claimant’s claim of constructive unfair dismissal on the basis of a breach of the implied term of trust and confidence is dismissed in the following circumstances and because:[1]The claimant remains in the employment of R1; her employment which commenced on 1st August 2016 continues to date and is not subject to Notice of termination;[2]The claimant’s withdrawal is without prejudice to any future claim of Unfair dismissal, Constructive Unfair Dismissal or other claim, based on some or all of the allegations set out in this Claim;[3]No evidence has been heard or any judgment made on the merits of the Claim as presented and therefore no issues have been adjudicated;[4]The claim was presented by the claimant as a Litigant in Person and without professional advice or representation; the dismissal claim was included in error; Case Number: 1601837/2021 2[5]The claim is withdrawn today in the above circumstances and subject as stated.
