JUDGMENT
[1]The respondent was aware of the hearing following notice sent on 23 August 2023. It was in the interests of justice to continue with the hearing in the absence of the respondent as they had not provided a response to the claim or made an application to participate in the proceedings following a rule 21 notice issued on 05 October 2023.[2]The respondent did not pay the full amount to the claimant for his accrued holiday at the end of his contract.[3]The respondent has paid the claimant the equivalent of £1250 gross in respect of outstanding holiday pay.[4]The claimant was entitled to a total of £4522.98 for accrued holiday calculated as follows: 42 days leave @ a daily rate of 107.69 = £4522.98[5]The respondent is ordered to pay the claimant £3272.98.
