JUDGMENT

[1]The claimants’ claims of having suffered detriments on the grounds of having made protected disclosures contrary to s47B Employment Rights Act 1996 are dismissed on withdrawal.[2]The claimants’ claims of having been unfairly dismissed contrary s103A Employment Rights Act 1996 are dismissed on withdrawal . ---1--- Case No: 1601672/2014 1601673/2014 1601674/2014

REASONS

[1]On the morning of the third day of the final hearing the claimants through their solicitor Ms Richards withdrew all claims which are therefore dismissed. The parties have raised a number of consequential matters. The respondent proposes to make an application for its costs; and the claimants are to seek an order in respect of the ongoing High Court proceedings. The following directions are agreed:- Directions[1]No later than 4.00pm 10th May 2017:- a) The respondent shall serve on the claimant and tribunal a Schedule of Costs together with an application for costs and any documents relied on in support. b) The claimants shall serve on the respondent and tribunal any application to rely on documents produced for the purpose of Employment Tribunal litigation in the High Court litigation identifying in particular the documents in respect of which they seek an order.[2]No later than 4.00pm 17th May 2017 both parties shall serve on the other and the tribunal any written response to the applications.[3]The case will be relisted for 22nd May 2017 to determine the applications.
