Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made unauthorised deductions from the claimant's wages.[2]The claimant was dismissed in breach of contract in respect of notice.[3]The respondent has failed to pay the claimant’s holiday entitlement.[5]The claim succeeds and the remedy to which the claimant is entitled will be determined at a Remedy Hearing if requested by the respondent and allowed by an Employment Judge in the exercise of discretion according to the overriding objective of the tribunal. Vincent Ryan Date: 18th September 2020[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross/net sum of £ 7,296.80[2]The respondent breached the contract of employment with regard to notice termination and damages are claimed in the sum of £ 18,680.32[4]The respondent has failed to pay the claimant’s accrued holiday pay in the sum of £ 925.84.[5]The claimant has partially mitigated his loss, in the sum of £ 5,552.90 such that his total claim amounts to £ 23084.23 (subject to the usual statutory deductions).
