The claim is struck out.REASONS
[1]A preliminary hearing took place on 23 March 2023. The claimant failed to attend. The claimant had failed to comply with earlier directions to provide an impact statement and disclose medical records. He was provided with an extension of time to 6 April 2023. This was accompanied by a strike out warning. The claimant did not comply with the orders and has to date failed to do so.[2]A further preliminary hearing took place on 17 July 2023 before Judge Brady. The claimant attended but said he was not well enough to take part in the hearing and needed an interpreter. This hearing was postponed. The claimant was given a further extension of time to comply with the above directions to 31 August 2023 and was directed to file medical evidence confirming his condition or a sick note within 14 days. He failed to comply with these orders. 6.2 Strike out Judgment – claim - rule 37 Case No: 1601489/2022[3]By a letter dated 15 September 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because he had not complied with the Orders outlined above and was failing to actively pursue his claim.[4]The claimant has failed to make representations in writing, and failed to attend the hearing today to make any sufficient representations The claim is therefore struck out.
