The Respondent’s Contract Counter Claim is struck out.REASONS
[1]By a letter dated 20 November 2020 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out.[2]The respondent has failed to make such representations and the counter claim is therefore struck out on the basis that the respondent has not complied with the order of the Tribunal.[3]The claimant’s claims will proceed. _____________________________ Employment Judge S Jenkins Date – 24 February 2021[1]The Respondent has made an unlawful deduction from the Claimant’s wages and is ordered to pay the Claimant the gross sum of £5832.[2]The Respondent has failed to pay the Claimant’s holiday entitlement and is ordered to pay the Claimant the gross sum of £287.67[3]The Claimant is responsible for any income tax or employee national insurance contributions that may be due on the sums awarded in respect of unpaid wages and unpaid holiday pay.
