JUDGMENT
[1]The claimant’s application to amend to bring a notice pay claim and a claim for annual leave accrued and outstanding on termination of employment is granted;[2]The claimant was constructively unfairly dismissed;[3]The respondent, in breach of contract, failed to pay the claimant’s notice pay;[4]The respondent failed to pay the claimant’s accrued and outstanding holiday pay on the termination of her employment;[5]The respondent made unauthorised deductions from wages in respect of salary and commission due to the claimant prior to the termination of her employment. Remedy[6]The claimant is awarded the gross sum of £1205.98 in respect of her breach of contract claim for 2 weeks’ unpaid notice pay; Case Number: 1601197/ 2020[7]The claimant is awarded the gross sum of £565.50 in respect of accrued and outstanding holiday pay on the termination of her employment;[8]The claimant is awarded the gross sum of £1837.09 in respect of unpaid salary and commission prior to the termination of her employment;[9]In respect of the unfair dismissal the claimant is awarded a basic award of £942.50;[10]The claimant is further awarded a compensatory award of £5787.33 in respect of net loss of earnings, loss of employer pension contributions and loss of statutory rights.
