[1]The claimant failed to attend the preliminary hearing on Monday 26 November 2018.[2]Upon enquiries that were made at the commencement of the hearing, the claimant confirmed that their absence was due to the claim being withdrawn. This had not been previously notified to the respondent, their representative or the Tribunal.[4]In circumstances where the respondent was alleging that the claim had not been actively pursued and the final hearing was not able to be proceeded with, it is fair and just to dismiss this claim.
