JUDGMENT
[1]The Claimant’s complaints of unauthorised deductions from wages in the form of unpaid wages, unpaid notice pay and unpaid holiday pay are made out and allowed.[2]The Claimant’s complaint that the Respondent breach duty to provide written particulars of employment is made out and allowed.[3]The Respondent’s contract claim is not made out and is dismissed.[4]The Respondent must pay the Claimant the sum of £2,731.57, calculated as follows: £ 4.1. Wages 451.57 4.2. Notice pay 600.00 4.3. Holiday pay 480.00 4.4. Breach of duty to provide written particulars 1,200.00 Total 2,731.57[5]In respect of Paragraphs 4.1, 4.2 & 4.3, the Respondent is entitled to deduct any tax and employee’s national insurance contributions due on - 1 - Case Nos: 1600994/2022 1600139/2023 those amount before payment to the Claimant. If not deducted by the Respondent, the Claimant must account to HMRC for any tax and national insurance contributions.[6]The Employment Protection (Recoupment of Jobseeker’s Allowance & Income Support) Regulations 1996 do not apply.
