JUDGMENT

It is the decision of Employment Judge G Duncan that:[1]The Claimant was unfairly dismissed by the Respondent.[2]The Respondent is ordered to pay the Claimant a basic award in the gross sum of £1122.[3]The Respondent is ordered to pay the Claimant a compensatory award in the net sum of £9638.22.[4]The Respondent has failed to pay the Claimant’s notice pay and is ordered to pay the Claimant gross sum of £1399.[5]The Respondent has failed to pay the Claimant’s holiday entitlement and is ordered to pay the Claimant the gross sum of £527.[6]The Respondent has failed to pay the Claimant’s pension contributions and is ordered to pay the Claimant the gross sum of £552.49.[7]The Respondent shall pay the Claimant for loss of statutory rights in the sum of £500. Case Number:[8]The compensatory award is subject to a 25% uplift due to the Respondent’s failure to act in accordance with the ACAS guidelines and shall pay the Claimant the sum of £1445.73.[9]The Respondent shall pay the Claimant the total sum of £15184.44.[10]The claimant is responsible for any income tax or employee national insurance contributions that may be due on the sums awarded in respect of unpaid holiday pay and notice pay.
