JUDGMENT
[1]The claimant withdrew her application to amend her claims to include claims that the respondent discriminated against her in relation to or because of the protected characteristic of disability; any such claims intimated in the claimant’s claim form are withdrawn also; by agreement of the parties those claims were not dismissed; no further action is to be taken by the tribunal as the claimant may pursue such claims in an alternative jurisdiction and the tribunal’s case file will be closed;[2]The claimant’s claims that the respondent discriminated against her because of her protected characteristics of nationality and/or ethnic origin, which she states as Filipino, are not well-founded, fail and are dismissed;[3]The respondent did not breach the claimant’s contract in a fundamental particular; her claim that the respondent committed a repudiatory breach of contract, by breaching the implied term of trust and confidence, is not well-founded, fails and is dismissed.
