JUDGMENT

The claim is struck out.

REASONS

[1]The first respondent company is in compulsory liquidation. The permission of the court has not been obtained for these proceedings to be instituted or continued as required by the Insolvency Act 1986.

[2]On 14 June 2022 the Tribunal gave the claimant an opportunity to give written reasons within 14 days why the claim should not be struck out as it had not been actively pursued. The claimant has failed to give an acceptable reason.

[3]The claim against the first respondent is therefore struck out. The claim against the second respondent continues. _____________________________ Employment Judge Sharp

[1]By a letter dated 06 July 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out against the second respondent because:• the claimant had not complied with the Order of the Tribunal dated 25 November 2021, paragraph 5.

[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim against the second respondent is therefore struck out.
