UPON the Respondent accepting that the Claimant is entitled to be paid for any accrued but untaken statutory annual leave and confirming that the Claimant has been or will be paid such sums as he is entitled to:[1]The Claimant’s complaint of unfair dismissal pursuant to section 98 of the Employment Rights Act 1996 fails and is dismissed.[2]The Claimant’s notice pay complaint fails and is dismissed.[3]The Claimant’s holiday pay complaint (insofar as it relates to accrued but untaken enhanced contractual leave) fails and is dismissed.
