JUDGMENT
[1]The judgment of the Tribunal is that the claimant’s following claims are dismissed upon withdrawal by her, namely: 1.1. Direct disability discrimination (s.13 Equality Act 2010 (EqA)); 1.2. Discrimination arising from disability (s.15 EqA).[2]This judgment does not affect the claimant’s claims of constructive unfair dismissal and of disability discrimination by breach of the duty to make reasonable adjustments which are being actively pursued. Ryan Date: 10.01.22[1]Parties having agreed terms of settlement with the assistance of ACAS, these proceedings are stayed until 16th May 2022, to enable the parties to comply with those terms of settlement.[2]On 17th May 2022, the Claimant’s claims will be dismissed upon withdrawal, unless the Claimant has written to the Tribunal indicating she wishes these proceedings to continue.[3]If the Respondent fails to comply with the terms of settlement, it is essential that the Claimant writes to the Tribunal before 16th May 2022 – the effect of paragraph 2 of this Judgment means these proceedings will be automatically dismissed, without the need for any further order or application, if the Tribunal has no further contact from the Claimant prior to that date.
