JUDGMENT

Upon there being no attendance by or on behalf of the respondent and having heard evidence from the claimants, the employment judge’s decision is:[1]The correct name of the respondent is The Cleaning People Facilities Limited, which has gone into voluntary liquidation.[2]The respondent has dismissed Mr Pugh and Mrs Rogers on grounds of redundancy.[3]Mr Pugh is owed £680 (gross) for outstanding wages and £238 (gross) for unpaid holiday pay. Mr Pugh is responsible for any income tax or employee national insurance contributions that may be due on the sums awarded in respect of the unpaid wages and unpaid holiday pay.[4]The total amount owed to Mr Pugh is £918.[5]Mrs Rogers is owed £680 (gross) for outstanding wages and £204 (gross) for unpaid holiday pay. Mrs Rogers is responsible for any income tax or employee national insurance contributions that may be due on the sums awarded in respect of the unpaid wages and unpaid holiday pay. Case No: 1600711/2019 & 1600814/2019[6]The total amount owed to Mrs Rogers is £884.[7]As the respondent company has gone into voluntary liquidation, it is likely Mr Pugh and Mrs Rogers will face difficulty recovering these debts from the respondent. If they are unable to recover these debts from the respondent, they are referred to section 166(1)a Employment Rights Act 1996, which explains their right to claim payment from the National Insurance Fund.[8]The Employment Protection (Recoupment of Jobseekers Allowance & Income Support) Regulations 1996 do not apply to this award.
