JUDGMENT
[1]The following claims are well-founded and succeed: 1.1. The Respondent failed to provide the Claimant with an itemised pay statement in respect of the payment of wages made on 1 November and 1 December 2023; no deductions were made from either payment, and therefore no award is made. 1.2. The Claimant claimed that the Respondent made a deduction from wages in respect of tips; without admission of liability, the Respondent offered to settle the claim in the sum of £46 and that offer was accepted, such that the claim is withdrawn on settlement.[2]The following claims are not well-founded, fail and are dismissed: 2.1. Age Discrimination 2.2. That the Respondent failed to pay holiday pay due to her. 2.3. That the Respondent made unauthorised deductions from her wages by paying her at a reduced hourly rate of £11.00 instead of £11.50. Case Number: 1600700/2024 2.4. Breach of Contract in relation to Notice of termination - Wrongful Dismissal. 2.5. That when proceedings were begun, the Respondent was in breach of its duty to give the Claimant a written statement of employment particulars.[3]In consequence of the above the Respondent shall pay to the Claimant £46.
