JUDGMENT
The judgment of the Tribunal is that the Claimant is awarded arrears of pay in the total sum of £3,790.20 gross being a net payment of £2,845.75.REASONS
[1]The Claimant was employed as a booking agent by the Respondent from 18 May 2017 to 28 February 2019 at which stage he resigned from his employment because he could not make ends meet due to his low wages with the Respondent.[2]The Claimant was earning a basic salary of £7,050 a year for a 35 hour working a week which translated to £600 per calendar month. The Claimant requested throughout the course of his employment an increase in salary which never arose. Towards the end of his employment, he consulted with Acas and took independent advice to the effect that he was being paid less than the National Minimum Wage. The Claimant had a reason to discuss the matter with the Respondent thereafter who agreed after reviewing the position to pay the Claimant arrears of pay being the difference between the National Minimum Wage and his salary from 2017 until the end of February 2019. The Claimant was sent a spreadsheet confirming this by the Respondent as well as a wage slip confirming the arrears of pay owed to him amounting to £3,790.20 gross and £2,845.75 net. The payslip Case Number: 1600556/2019 expressed the pay date as 1 April 2019. The Respondent failed to pay the Claimant this amount. As a consequence, the Claimant issued these proceedings and attended in person to explain his case at today’s Tribunal hearing. On the basis of the Claimant’s evidence and on the admissions made by the Respondent in respect of documentation seen by the Tribunal relating to the spreadsheet of the payments owed to the Claimant as well as the payslip dated March 2019, the Tribunal made the above award.
