JUDGMENT

The judgment and declaration of the Tribunal is that:[1]The respondent failed to honour the claimant’s entitlement to rest breaks under the Working Time Regulations 1998, but no award of compensation is appropriate;[2]The claimant is entitled to a redundancy payment from the respondent being the outstanding balance due in the sum of £84.67 (the remainder having been paid);[3]The respondent breached the claimant’s contract in respect of notice on termination, having paid less than was due to him in notice pay, and it shall pay to him the outstanding balance £96.15 (subject to the usual statutory deductions);[4]The respondent failed to pay holiday pay due to the claimant in the sum of £2,537.25 and it shall pay that sum to him (subject to the usual statutory deductions); Case No. 1600387/2018[5]The respondent made unauthorised deductions from the claimant’s wages in the sum of £298.41 and it shall pay that sum to him (subject to the usual statutory deductions);[6]In consequence of the above the respondent shall pay to the claimant £3,016.48 (subject as above).
