JUDGMENT

[1]The respondent dismissed the claimant fairly on 23rd October 2018 for a reason related to capability by reference to health; the claimant’s claim that he was unfairly dismissed fails and is dismissed.

[2]The claimant’s claim that the respondent failed to make reasonable adjustments in accordance with ss 20-21 Equality Act 2010 fails and is dismissed.

[3]The respondent did not discriminate against the claimant by treating him unfairly because of something arising in consequence of his disability in circumstances where the respondent was able to show that the treatment was a proportionate means of achieving a legitimate aim. The claimant’s claim under s.15 Equality Act 2010 fails and is dismissed.
