JUDGMENT

[1]The Tribunal has no jurisdiction to determine the complaint of negligent misstatement and it is dismissed (pursuant to Rule 28 of The Employment Tribunal Procedure Rules 2024).

REASONS

[1]On 7 August 2026, EJ Williams issued notice under Rule 28 of The Employment Tribunal Procedure Rules 2024 that the Tribunal was of the view that it did not have jurisdiction to determine the complaint of negligent misstatement being advanced by the Claimant. The Claimant had until 13 August 2026 to explain why that complaint should not be dismissed.[2]Unfortunately, the notice was not sent to the parties until 13 August 2026 itself. To his credit, the Claimant responded the same day. In terms, he did not challenge the proposal to dismiss the complaint. He did however seek reassurance that the facts which he alleged founded that complaint could still be relied upon in support of his other complaints.[3]I can provide that reassurance. All that is being dismissed is the complaint. No findings are being made on the factual allegations the complaint relates to. The complaint is dismissed because it falls outside the types and categories of complaints which Parliament has empowered the Tribunal to decide.[4]The complaint is therefore dismissed.
