JUDGMENT

[1]The claimant’s claim that she was discriminated against in relation to the protected characteristic of disability (by association) was presented to the tribunal out of time in such circumstances that the Tribunal finds it would be just and equitable to extend time to the date of actual presentation;[2]The claimant’s claim that the respondent directly discriminated against her in relation to the protected characteristic of disability, by association, is not wellfounded, fails, and is dismissed;[3]The claimant was fairly dismissed by the respondent on 1 November 2018 for the substantial reason(s) that her absence level from work was “unacceptable” with serious adverse impact on the provision of a statutory service which was “unsustainable”, in circumstances where the respondent had no confidence that the claimant’s attendance would improve.
