Having heard evidence on oath from Mr Walsh and having considered the documentary evidence and the respondent’s written submissions the employment judge’s decision is:[1]Mr Walsh was an employee of the respondent from 3rd January 2011 and was unfairly dismissed on 19th November 2019.[2]The manner of his dismissal constituted a fundamental breach of his employment contract.[3]Acerchem Uk Ltd is ordered to pay Mr Walsh:a. £12,458.05 for breach of contract, namely failure to pay notice pay / provide notice of dismissal; andb. £11,106.65 for unfair dismissal.[4]The total amount owed to Mr Walsh, by Acerchem UK Limited is £23,564.70 as set out in the Claimant’s Schedule of Loss.[5]The Employment Protection (Recoupment of Jobseekers Allowance and Income Support) Regulations 1996 do not apply.
