JUDGMENT
The claim is struck out.
REASONS
[1]The Tribunal does not have jurisdiction to hear the claim because: a) The claimant’s claim is in respect of alleged discrimination under Part 6 of the Equality Act 2010 which falls under the exclusive jurisdiction of the County Court (Section 114 (1) and / or; b) The claim is out of time and it would not be just and equitable to extend time.[2]The claimant is ordered to pay the respondent’s costs in the sum of £551.50 under Rule 78 (1) Employment Tribunal Rules of Procedure
