[1]By a letter dated 26 June 2023 the Tribunal gave the claimant an opportunity to make explain in writing why he did not attend a scheduled hearing on 23 June 2023 or notify the tribunal of his non-attendance. Employment Judge Moore noted that if there is no response, she would consider striking out the claim under Rule 38 Employment Tribunal Rules of Procedure because:• The claimant has failed to comply with case management orders.• It has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
