JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21 Following the respondent’s decision to withdraw from Tribunal proceedings and there being sufficient material before me to enable a proper determination to be made, I uphold the following claims[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £1,600.[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £6,400.[3]The unfair dismissal claim also succeeds but the remedy to which the claimant is entitled will need to be determined at a Remedy Hearing. The claimant is responsible for any income tax or employee national insurance contributions that may be due on the sums awardsd in respect of notice and unpaid holiday pay.
