JUDGMENT

ON APPLICATION TO AMEND The claimant’s application to amend the originating application is granted as follows:[1]AHR Employment and Safety Services Ltd is joined as Second Respondent to the claim[2]The claim is amended and time extended, it being just and equitable to do so, to include – i) The handling of the grievance investigation:  Harassment related to disability, namely the failure to investigate the disability complaint  Harassment related to disability, namely the failure to interview witnesses with the intention of protecting Tiffany from scrutiny ii) The handling of the Grievance appeal:  The failure to make a reasonable adjustment by permitting a companion at any meeting in the grievance appeal  The failure to make reasonable adjustments to permit the companion to address the meeting (and see para 39 ACAS Code of Practice)  Harassment related to disability in failing to record the disability related reasons for the appeal or to address the disability related grounds for the grievance Case No 1406037/2020 The claimant’s application as follows in the Further and Better Particulars of 7 September 2021 to amend the originating application is refused:[3]That Tiffany rolled her eyes at the reference to the Claimant’s disability on 22 July 2020[4]That Tiffany rolled her eyes during a video meeting at the reference to the Claimant’s bulimia on 18 August 2020
