JUDGMENT
[1]The Claimant was an employee of the Respondent within the meaning of section 230 of the Employment Rights Act 1996.[2]The Claimant was a worker of the Respondent within the meaning of section 230 of the Employment Rights Act 1996.[3]The Claimant is entitled to receive a statutory redundancy payment of £1075.25 calculated as follows; The Claimant’s average weekly pay is £195.50. At the time of his dismissal the Claimant had 6 years continuous service. He was under 22 for 1 year and over 22 and under 41 for 5 years. Therefore; (0.5 x 195.5) + (5 x 195.5) = £1075.25.[4]The Respondent will pay the Claimant a statutory redundancy payment in the sum of £1075.25.[5]The Claimant’s claim for unfair dismissal was not well founded and does not succeed.
