The claim is struck out under rules 37 (1)(c) and/or (d) of the Employment Tribunals Rules.REASONS
The case was listed for hearing on 23 March when standard directions were issued. It is clear from the file that the Respondent has had difficulty contacting the Claimant and there has been a failure to comply with case management directions. The Claimant failed to provide a calculation of his losses and, despite correspondence from both the Respondent and the Tribunal, there was no reply from him. On 10 July, the Claimant was specifically asked by the Tribunal to provide an indication of his alleged losses ‘by return’. He failed to respond to that correspondence. A strike out warning was issued on 22 July which required the Claimant to comply with the Tribunal’s directions by 29 July. Although the Tribunal did then receive an email from him, it contained no calculation of loss and was merely a copy of an email which he had sent on 25 February 2021, with one small sentence added. The Claimant has failed to engage with the Tribunal and the Respondent, has failed to comply with case management directions and to heed the warning of 22 July. His case is therefore struck out. The hearing will not take place.
