JUDGMENT

Claimant 1 is owed unpaid wages and holiday pay in the sum of £1409.78 (net of tax and national insurance). The respondent is ordered to pay this sum to Claimant 1. Claimant 2 is owed unpaid wages and holiday pay in the sum of £1485.01 (net of tax and national insurance). The respondent is ordered to pay this sum to Claimant 2. The claims for breach of contract are dismissed.

REASONS

[1]The respondent accepts that these monies are owed to the claimants. They relate to work done in August 2019. I have ordered that the sums owing be paid.[2]Mrs Hanson has told me that the respondent holds a pay slip for August 2019 and P45 (for tax year 2019/2020) for each claimant to reflect this pay. She showed these to me on the screen and confirmed that these would now be sent to the claimants in the post. To date the claimants have not been paid the wages owing reflected on those pay slips.[3]Mrs Hanson told me that the respondent is going to enter insolvency proceedings and does not have the funds to pay the monies due.
