JUDGMENT
[1]The Claimant was unfairly dismissed by the First Respondent and is entitled to compensation in the total sum of £1,629.00, comprising;a. A basic award; Nilb. A compensatory award; £1,629.00.[2]The First Respondent failed to comply with the duties to inform and consult under regulation 13 of the Transfer of Undertakings (Protection of Employment) Regulations 2006 and the Claimant is entitled to compensation under regulations 15 (1)(d) and (8)(b) in the sum of £1,190.00 (8 weeks’ pay).[3]The recoupment regulations do not apply.[4]The complaint of failure to pay holiday pay is dismissed upon withdrawal.[5]The claims against the Second Respondent are dismissed.
