JUDGMENT
[1]The claimant’s claim of unlawful deduction from wages is well founded and upheld.[2]The respondent is ordered to pay the claimant the sum of £650.00.REASONS
[1]By this claim the claimant brought claims of the unlawful deduction from wages in two respects. Firstly he claimed that he was owed unpaid overtime; and secondly that £650 had been deducted from his final salary. ---1--- Case No: 1405575/2023[2]Neither party had complied with case management orders to agree a bundle, and there were no documents before me in relation to the unpaid overtime claim. However the claimant stated that all he was actually seeking was the payment of £650 unlawfully deducted. The respondent did not dispute that the deduction had been made, but stated that the deduction had been made as the claimant had retained some electronic equipment ( a phone and tablet). It accepted that the deduction was not made pursuant to any contractual right, or after having contained the claimant’s written consent. In the circumstances it accepted that the deduction was unlawful.[3]Both parties indicated that they were content for me to give judgment for the £650 deducted from the claimant’s final salary. The respondent pointed out that the claimant still had the electronic equipment which remains its property, but indicated that it was content if the property was returned immediately on the £650 being paid .
