JUDGMENT
[1]The Employer’s Counterclaim is dismissed on its withdrawal by the Respondent.[2]The Claimant’s claim for non-payment of holiday pay is dismissed on its withdrawal by the Claimant.[3]The Claimant’s claim of an unlawful deduction of wages contrary to s.13 ERA 1996 is not well founded and is dismissed.[4]The Claimant’s claim of breach of contract in relation to the payment of notice pay is well-founded and succeeds.[5]The Claimant received pay exceeding the sums due as notice pay and no compensation is due to the Claimant.
