Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the Southampton Employment Tribunals on 29 December 2021. The Respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The Claimant was dismissed in breach of contract in respect of notice and the Respondent must pay damages to the Claimant of £2571.97 net.[3]The Respondent has failed to pay the claimant’s holiday entitlement in respect of 2 days leave accrued on termination and must pay the Claimant the sum of £512.82 gross.[4]The Respondent has made an unlawful deduction from the Claimant’s payment wages of £938.10 net. The Respondent must now pay the Claimant the sum of £938.10 net.[5]The total sum now payable to the Claimant by the Respondent is therefore £4022.89.
